1. Who we are

These Terms of Service (“Terms”) govern your access to and use of the MoonMiles platform, including our websites, apps, games, offerwalls, surveys, and related services (collectively, the “Services”). “MoonMiles” means MoonMiles Labs Ltd. (or its applicable affiliate). Contact us at support@moonmiles.io.

2. Acceptance of the Terms

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services.

3. Eligibility

  • You must be at least 13 years old (or the age of digital consent in your region). If you are under 18, you represent that you have parental/guardian consent.
  • You may not use the Services where prohibited by law. You are responsible for ensuring your use is legal in your jurisdiction.
  • One account per person and per household (unless we approve otherwise in writing).

4. Account & Security

  • Provide accurate information and keep it updated.
  • Maintain the confidentiality of your credentials. You are responsible for activities under your account.
  • We may suspend or terminate accounts for suspected fraud, abuse, multi-accounting, policy violations, or unlawful activity.

5. Services Overview

MoonMiles offers: (a) earn experiences via offerwalls, tasks, surveys, and promotions; (b) games such as crates, battles, or ladder-style experiences that use in-platform units; (c) an affiliate/referral system; and (d) a rewards catalog (“Rewards”) that may include digital gift cards, crypto payouts via supported third parties, or other items we list from time to time.

6. Coins, Credits, XP & Rewards

  • Coins/XP may be earned for completing eligible activities; Credits may be purchased or converted from Coins. Coins/XP/Credits are in-platform units with no cash value.
  • Coins/XP/Credits are non-transferable, cannot be exchanged for fiat or crypto, and exist solely within MoonMiles.
  • Rewards become available only when all requirements (including verification and anti-fraud checks) are satisfied. Supply is limited and subject to availability.
  • Erroneous, fraudulent, or exploit-gained units/Rewards may be voided. We may reverse or withhold balances we reasonably suspect were obtained improperly.
  • Some Rewards are delivered by third parties. Delivery timelines and terms may vary.

7. Games & Chance Elements

Certain features (e.g., crates, battles, ladder) include randomized outcomes. These are entertainment experiences using Credits and do not reflect real-world monetary value. Do not participate if such mechanics are restricted in your location.

8. Purchases; Refunds

  • Purchases of Credits are final and non-refundable, except where required by law.
  • Taxes, fees, and FX may apply. You authorize us or our payment processors to charge your payment method.

9. Verification; AML/KYC

To protect the platform and comply with laws (e.g., anti-fraud/AML), we may require you to verify your identity, age, residence, phone number, or payment accounts before enabling redemptions or certain features. If you do not complete verification to our reasonable satisfaction, we may suspend or restrict Rewards and access.

10. Prohibited Conduct

  • Fraud, spoofing, VPN/proxy circumvention where prohibited, botting, farming, multi-accounting, or coupon/offer abuse.
  • Reverse engineering, scraping, interfering with security, or disrupting Services.
  • Using the Services for unlawful purposes or to violate third-party terms (including advertiser/offerwall rules).

11. Third-Party Offers & Links

Offers and some tasks are run by third parties with their own terms and privacy practices. We are not responsible for third-party websites, apps, wallets, or services. Participate at your own risk and review their policies carefully.

12. Taxes

You are solely responsible for any tax obligations related to your use of the Services or Rewards received.

13. Intellectual Property

The Services, software, content, branding, and materials are owned by MoonMiles or its licensors. We grant you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes. All rights reserved.

14. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted, error-free, or virus-free operation; accuracy or completeness of content; or availability of Rewards.

15. Limitation of Liability

To the maximum extent permitted by law, MoonMiles will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits/revenue/data/goodwill. Our aggregate liability for all claims relating to the Services will not exceed the greater of (a) USD $100 or (b) the amount you paid to us (if any) in the 3 months prior to the event giving rise to the claim.

16. Indemnity

You will indemnify and hold MoonMiles and its affiliates harmless from any claims, losses, and expenses (including attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party right.

17. Suspension & Termination

We may suspend or terminate access (with or without notice) if we reasonably believe you violated these Terms, present a fraud/abuse risk, or for operational/legal reasons. You may close your account by contacting support@moonmiles.io.

18. Inactive Accounts

Accounts with no login activity for 24 months may be closed. Unredeemed in-platform units may expire and be forfeited.

19. Changes to the Services & Terms

We may modify the Services or these Terms at any time. Material changes will be communicated by reasonable means (e.g., in-app notice). Continued use after changes constitutes acceptance.

20. Governing Law; Dispute Resolution

These Terms are governed by the laws of Newfoundland and Labrador, Canada, without regard to conflict of law rules. Courts in Newfoundland and Labrador shall have exclusive jurisdiction, unless mandatory law provides otherwise.

22. Miscellaneous

  • Entire Agreement. These Terms, together with policies referenced, are the entire agreement.
  • Severability. If a provision is unenforceable, the remainder remains in effect.
  • Assignment. You may not assign without our consent; we may assign as permitted by law.
  • No Waiver. Failure to enforce is not a waiver.
  • Language. The English version controls where translations differ.
